However, the petitioner's claim, which concerns the ownership and title to land, falls squarely within the jurisdiction of the Environment and Land Court as provided by Article 162(2)(b) of the Constitution and Section 13 of the ELC Act. Section 76 of the Co-operative Societies Act does not grant the Co-operative Tribunal jurisdiction over disputes involving title to land, even if a Sacco is a party.
