Procedural Posture

Civil Case / Judgment

  1. 1 Whether the Plaintiffs are the lawful proprietors of the suit properties (LR Nos. 114, 115, 116, 117 and 118) in Watamu Township.
  2. 2 Whether the Defendant unlawfully entered and interfered with the Plaintiffs' proprietary rights over the suit properties.
  3. 3 Whether the Plaintiffs are entitled to a perpetual injunction restraining the Defendant from entering or interfering with the suit properties.

Ratio Decidendi

The Plaintiffs' titles to the suit properties were registered first in time under the Registration of Titles Act, which was the applicable law for former Crown Lands. The Defendant's title, registered later under the Registered Land Act, did not cancel or override the Plaintiffs' earlier titles. The Plaintiffs' titles were not shown to have been obtained by fraud or misrepresentation. The law protects the sanctity and indefeasibility of title under the Registration of Titles Act, and the Plaintiffs' proprietary rights were unlawfully interfered with by the Defendant. The Plaintiffs are therefore entitled to the reliefs sought, including a perpetual injunction and costs.

  • The Defendant shall pay the costs of the consolidated suits to the Plaintiffs.
