The Supreme Court held that the creation of administrative units is a function distinct from the delimitation of electoral (constituency) boundaries. The advertisements issued by the Cabinet Secretary for Interior and Coordination of National Government related solely to recruitment for administrative positions and did not alter or affect constituency boundaries, which is the exclusive mandate of the IEBC under Article 89 of the Constitution. The administrative units in question were created in 2010, prior to the enactment of the National Government Coordination Act, 2013; thus, the Act could not apply retrospectively to their creation.
