The purchase price of KShs 7,020,000 was fixed and not subject to adjustment based on the actual acreage determined after survey. The Defendant was not entitled to pay pro rata for the acreage transferred but was obligated to pay the full purchase price for the wayleave trace as defined in the agreement.
