The court found that, following the withdrawal of the applicant's counsel, service of the Notice of Taxation was effected personally on the applicant as evidenced by an uncontroverted affidavit of service by the process server. The applicant failed to file any affidavit denying personal service. Regarding the execution process, the court held that the applicant did not discharge the burden of proving irregularity or illegality in the attachment and sale, as there was no sufficient evidence to contradict the auctioneer's account. The application was therefore dismissed for lack of merit.
