Procedural Posture

Succession Cause / Ruling on Application to Revoke Grant of Letters of Administration

  1. 1 Whether the grant of letters of administration intestate was obtained by concealment of material facts or fraud.
  2. 2 Whether the Objector is entitled to exclusive inheritance of the deceased's estate under customary law to the exclusion of other beneficiaries, including the Petitioner.
  3. 3 Whether the Objector provided sufficient evidence of a gift or will bequeathing the property solely to him.

Ratio Decidendi

The Objector failed to provide evidence that the grant was obtained by fraud or concealment of material facts, or that the deceased's property was bequeathed to him exclusively by will or under customary law. The court found no proof of a written or oral will in his favor, nor evidence of a customary law entitling him to sole inheritance. The Objector's delay in objecting to the grant and his failure to include other potential beneficiaries undermined his claim. The court held that, under the Law of Succession Act, all grandchildren are entitled to a share of the estate, and any customary law excluding women is unconstitutional. Therefore, the application to revoke the grant was dismissed.

Court Disposition

Objector's application dismissed.

Orders
