The respondent failed to provide the petitioner with adequate particulars of the allegations, did not serve her with relevant documents, and did not give her reasonable time or opportunity to prepare a defence, especially during her maternity leave. The disciplinary process was not conducted in accordance with Section 41 of the Employment Act, and the resignation was precipitated by undue influence from the respondent, amounting to constructive dismissal. The deductions from the petitioner’s terminal dues were not sufficiently justified by evidence of liability....
