The defence filed by the respondent after judgment was irregular and of no effect, and thus liability was settled in favour of the appellants. The trial magistrate erred in requiring proof of negligence and in finding the suit statute barred, as the plaint pleaded leave to file out of time and no proper defence was on record to challenge this.
