Ratio Decidendi

The court found that while the Claimant was on probation and thus excluded from the procedural protections of Section 41 of the Employment Act, she was still entitled to notice or pay in lieu of notice as per her contract. The Respondent's summary dismissal did not afford the Claimant an opportunity to mitigate her case, but since Section 42(1) excludes probationary contracts from Section 41, the claim for unfair termination on the ground of lack of hearing failed. However, the court converted the summary dismissal to a normal termination and awarded the Claimant one month's salary in lieu of notice, prorata leave for completed months, and prorata pay for the period worked in April 2011....
