The court found that the 1st defendant was entitled to the release of funds held in the joint account pursuant to the judgment delivered on 25th October 2018. The plaintiff's advocate's refusal to cooperate in closing the account and releasing the funds constituted non-compliance with a court order. Section 98 of the Civil Procedure Act empowers the court to authorize a third party to execute necessary documents where a party refuses or neglects to do so. Accordingly, the court ordered the closure of the joint account, the release of all funds (less bank charges and statutory deductions) to the 1st defendant's advocates, and authorized the Senior Deputy Registrar to sign any necessary...
