While part of the delay was covered by a certificate of delay, a significant period remained unexplained or insufficiently supported by evidence. The court also noted that the applicant did not provide a draft memorandum of appeal, making it impossible to assess the arguability or prospects of success of the intended appeal. Furthermore, the court held that the unexplained and inordinate delay would occasion undue prejudice to the respondent. Consequently, the court declined to exercise its discretion to grant the extension of time sought by the applicant.
