Furthermore, the court determined that the subject matter, parties (or their privies), and issues in the present suit were substantially the same as those in Oyugis PMCC number 147 of 2011, which had been heard and determined on its merits. Therefore, the doctrine of res judicata applied, barring the present suit. The preliminary objection was upheld, and the suit was struck out with costs to the defendant.
