Procedural Posture

Employment and Labour Cause / Ruling on Objection to Committal to Civil Jail

  1. 1 Whether the Liquidator remains liable for execution of the decree after the lapse of the gazetted period without formal discharge.
  2. 2 Whether the Liquidator can be committed to civil jail for non-payment of the decretal sum owed to the Claimants.

Ratio Decidendi

The court held that the law requires a liquidator to seek formal discharge from the Commissioner after completing liquidation proceedings. The mere lapse of the gazetted period does not terminate the liquidator's obligations. Since the Liquidator had not applied for or obtained such discharge, he remained responsible for the execution of the court's decree and was therefore liable for committal for non-payment of the decretal sum. The court found that the Liquidator's duties persist until proper discharge is granted, and the absence of such discharge means he continues to act in his official capacity and can be held accountable for the society's obligations under the decree.

Court Disposition

Objection dismissed; Liquidator held liable for committal for non-payment of decretal sum.
