The High Court, as a first appellate court, independently reviewed the evidence and found that the trial magistrate's finding of 100% liability against the appellant was supported by unshaken eyewitness testimony and was not based on any misapprehension of the facts or law. The court further held that the award of KShs.800,000 in general damages was justified given the nature and severity of the respondent's injuries, and there was no evidence that the trial court acted on wrong principles or made an erroneous estimate. Consequently, there was no basis to interfere with either the finding on liability or the quantum of damages, and the appeal was dismissed with costs to the respondent.
