Procedural Posture

Stay Application / Ruling on Application for Stay of Execution and Proceedings Pending Appeal

  1. 1 Whether the applicants have met the threshold for grant of stay of execution and stay of proceedings pending appeal.
  2. 2 Whether the High Court's order revoking the grant and requiring surrender of the original grant can be stayed.
  3. 3 Whether the appeal would be rendered nugatory if stay is not granted.

Ratio Decidendi

The Court found that the High Court had already revoked the grant and that the order for surrender of the original grant was consequential. Therefore, a stay of execution of the order for surrender was misconceived, as the grant no longer existed unless the appellate court set aside the High Court's decision. However, the Court recognized its jurisdiction to stay proceedings to ensure that the appeal, if successful, would not be rendered nugatory. Given the gravity of the dispute and to preserve the estate, the Court granted a stay of further proceedings and ordered maintenance of the status quo regarding the estate assets and registers, restraining any further dealings or conveyances...

Court Disposition

Application allowed in part; stay of proceedings and status quo orders granted pending appeal.

Orders

  • Further proceedings consequent to the High Court orders dated 6th February, 2018 are stayed pending hearing and determination of the appeal.
  • Status quo in respect of the assets of the estate already transferred to the beneficiaries shall be maintained; beneficiaries are restrained from further dealing with the properties including conveyance thereof pending determination of the appeal.
