Ratio Decidendi

The court found that the appellants had demonstrated they would suffer substantial loss if stay was not granted, particularly as the 1st appellant risked serving a term in civil jail before the appeal could be heard. The court was satisfied that the appeal was arguable and not frivolous, and that the application for stay was filed timeously. Regarding security, the court held that it would be illogical to require the appellants to deposit the entire decretal sum as security when their application sought to liquidate the sum by instalments. Consequently, the court allowed the motion for stay of execution pending appeal on terms consistent with the prayers sought.
