The High Court found that the trial magistrate erred by making factual findings and giving directions without hearing the parties on disputed facts, particularly regarding the status of the attached vehicle and the proceeds from its sale. The magistrate's directions, which were based on erroneous or untested facts, amounted to an error apparent on the face of the record. Once the magistrate acknowledged that the objection proceedings had not been overtaken by events, he should have reviewed his earlier directions.
