The appellant failed to adduce any evidence to rebut the respondent's account or to demonstrate contributory negligence. The trial court was justified in finding the appellant 100% liable. On quantum, the appellate court found that the award of Kshs.800,000 in general damages was within the reasonable range of comparable awards for similar injuries and was not inordinately high. The appeal was therefore dismissed in its entirety, and the trial court's judgment was upheld.
