The Court of Appeal found that the applicants failed to satisfy both limbs required under rule 5(2)(b) for the grant of stay of execution. First, the intended appeal was not arguable because, after the withdrawal of the main suit, the counterclaim persisted as a separate cause of action, and the grounds of appeal raised no substantial issues for interrogation. Second, the applicants did not demonstrate that the appeal would be rendered nugatory if stay was not granted, as there was no leadership vacuum in the Church, with an acting presiding Bishop in place and the Church's functions continuing normally. The applicants failed to show any irreversible or highly prejudicial consequences...
