The court found that the plaintiff, Methodist Church in Kenya, is not a juristic person and therefore lacks the legal capacity (locus standi) to institute proceedings in its own name. This defect is fundamental and cannot be cured by amendment. The preliminary objection raised by the defendants was a pure point of law as defined in the Mukisa Biscuit case, and the lack of locus standi rendered the entire suit a nullity. Consequently, the suit was struck out in its entirety, but the court clarified that this does not preclude the institution of a new suit by a proper party.
