Procedural Posture

Civil Appeal / Directions on Interlocutory Application

  1. 1 Whether the appellant is entitled to urgent interim injunctive relief restraining the respondents from interfering with its PSV operations along the licensed route.
  2. 2 Whether the respondents' actions in obstructing or preventing the appellant from accessing designated PSV pick-up and drop-off points are lawful.

Ratio Decidendi

The Tribunal found that the appellant had demonstrated sufficient urgency and a prima facie case warranting ex parte interim protection. The appellant is a duly licensed PSV operator whose operations have allegedly been obstructed by the respondents. To preserve the status quo and prevent irreparable harm to the appellant's business pending inter partes hearing, the Tribunal granted a temporary injunction restraining the respondents from interfering with the appellant's use of the designated PSV pick-up and drop-off points along Tom Mboya Street and the licensed route. The orders are to be enforced by the relevant police authorities to ensure compliance.
