The court found that while the reasons for the delay in filing the notice of objection were not compelling or detailed, the delay of 12 days was not inordinate. The respondent would not suffer prejudice beyond a minor delay, which could be compensated by costs. Denying the applicant an opportunity to be heard would cause greater prejudice. The court exercised its discretion in favour of the applicant, guided by principles of fairness and justice under Article 50 of the Constitution, and allowed the extension of time for filing the notice of objection.
