The affidavits of service were inconsistent and the 1st Defendant's subsequent conduct, including filing a replying affidavit only after fresh service was ordered, cast doubt on the Plaintiff's claims of prior service. Without clear evidence of service, the court could not find the 1st Defendant in contempt. The Plaintiff failed to discharge the burden of proof required in contempt proceedings.
