Miscellaneous Criminal Application / Ruling on Application for Sentence Review

  1. 1 Whether the High Court has jurisdiction to review a sentence for robbery with violence based on the Supreme Court decision in Muruatetu.
  2. 2 Whether the Supreme Court decision in Muruatetu applies to offences other than murder.
  3. 3 Whether the applicant is entitled to sentence review in light of the directions given in Muruatetu (2021).

Ratio Decidendi

The High Court lacks jurisdiction to review the applicant's sentence for robbery with violence based on the Supreme Court's clarification in Muruatetu (2021) that its earlier decision on the unconstitutionality of mandatory sentences applies only to murder cases under section 204 of the Penal Code. The application for sentence review is therefore incompetent. Any issues regarding the sentence should have been raised on appeal, and the applicant cannot use a review application as a substitute for an appeal. The file is to be closed.
