The Court of Appeal held that the High Court correctly declined to strike out the respondent's suit, as the issues of res judicata, limitation, and Land Control Board consent were contentious and required full investigation at trial. Previous suits between the parties were dismissed for want of prosecution or withdrawn, and thus did not amount to final determinations on the merits as required by section 7 of the Civil Procedure Act. The application for striking out was interlocutory, and the court did not have the benefit of full evidence. The High Court, however, erred in making conclusive findings on the existence of Land Control Board consent and limitation at the interlocutory stage....
