Procedural Posture

Miscellaneous Application / Ruling on Application to Set Aside Dismissal and Reinstate Suit

  1. 1 Whether the order dismissing the suit for non-attendance should be set aside.
  2. 2 Whether the delay in filing the application to set aside the dismissal was justified.
  3. 3 Whether the suit should be reinstated on terms.

Ratio Decidendi

The court found that although there was an unexplained delay of about six months in filing the initial application to set aside the dismissal, the applicants acted promptly after being granted leave to file a fresh application. The court exercised its discretion in favour of the applicants, considering the quick action taken in the latter instance, and set aside the order of dismissal on condition that the applicants pay thrown away costs and the costs of the application within 15 days, failing which the suit would stand dismissed.

Court Disposition

Application allowed with conditions.
