Ratio Decidendi

The court found that while the applicant had not fully satisfied the requirement of demonstrating substantial loss, the application for stay of execution was filed without unreasonable delay. Given that preliminary matters relating to the admission of the appeal had not been finalized, the court exercised its discretion to grant a stay of execution, subject to the applicant depositing security in the sum of Kshs 819,000 within 30 days and continuing to pay monthly rent of Kshs 21,000 to the respondent from 1st September 2013 onwards. Failure to comply with these terms would result in the lapse of the stay and the respondent being at liberty to execute the judgment or decree.
