The Court of Appeal held that the issues raised by the appellant regarding identification of property, ownership of the house, and contradictions in evidence were matters of fact, which are not within the court's purview on a second appeal unless there is a clear misdirection or lack of evidentiary support. The court found no such misdirection. On the legal issues, the court determined that the discrepancy in the location stated in the charge sheet was either a typographical error or an immaterial irregularity, cured by Section 382 of the Criminal Procedure Code, as it did not occasion a miscarriage of justice.
