Procedural Posture

Preliminary Objection / Ruling on Preliminary Objection

  1. 1 Whether the court has jurisdiction to entertain a boundary dispute before the Land Registrar has determined the boundaries as required by law.
  2. 2 Whether the plaintiffs/applicants prematurely filed suit before exhausting the statutory procedure under the Land Registration Act.
  3. 3 Whether the application and suit are an abuse of court process.

Ratio Decidendi

The court found that the plaintiffs/applicants failed to follow the mandatory statutory procedure for resolution of boundary disputes as set out in Sections 18 and 19 of the Land Registration Act. The applicants did not give the Land Registrar the opportunity to determine the boundaries before approaching the court. The court held that, in the absence of a determination by the Land Registrar, it lacked jurisdiction to entertain the suit. The premature filing of the suit and application constituted an abuse of the court process. Consequently, the preliminary objection was upheld, and the suit and application were struck out with costs to the 1st defendant/respondent.

Court Disposition

preliminary objection upheld; suit and application struck out with costs to the 1st defendant/respondent

Orders

  • The plaintiffs'/applicants' suit and application are struck out.
  • Costs awarded to the 1st defendant/respondent.
