The High Court found that the interim inhibition orders issued by the Chuka Principal Magistrate’s Court on 1st March 2012 lapsed on 11th April 2012 when they were not extended. Furthermore, the lower court had expressly admitted it lacked jurisdiction to entertain the matter, rendering all orders it issued, including the inhibition orders, null and void ab initio. Since jurisdiction is a prerequisite for the validity of any court order, the inhibition orders could not be maintained. The High Court therefore ordered the removal of the inhibitions on the specified land parcels, finding no legal basis for their continued existence.
