The court held that the sale agreement entered into by the plaintiff with some of the beneficiaries of the estate of the late Stephen Wambua Kanyeti before confirmation of grant was null and void under Section 82(b)(ii) of the Law of Succession Act. The suit land was only allocated to the 1st defendant after confirmation of grant, and only then could a valid transfer occur. Since the plaintiff's agreement predated the confirmation, he acquired no enforceable proprietary interest in the land.
