The Court found that the applicants satisfied both limbs required for the grant of a stay under rule 5(2)(b): (1) the appeal is arguable, as it raises the issue of whether the trial court properly evaluated the evidence regarding the existence of a trust, and (2) the appeal would be rendered nugatory if the applicants were evicted before its determination, as they are in occupation of the disputed land and face imminent eviction. The Court therefore exercised its discretion to grant a stay of execution pending the hearing and determination of the appeal.
