Procedural Posture

Civil Appeal / Appeal From High Court Judgment on Judicial Review Application

  1. 1 Whether the High Court erred in law or fact in dismissing the appellant's application for review of the nomination dispute decision.
  2. 2 Whether the appellant was the duly nominated Ford-Kenya candidate for Embakasi Central Constituency.
  3. 3 Whether the court should order a repeat of the parliamentary elections in Embakasi Central Constituency.

Ratio Decidendi

The Court of Appeal found that the appellant failed to provide any new or important evidence or demonstrate an error apparent on the face of the record to justify review of the High Court's decision. The appellant did not exhaust internal party dispute mechanisms, nor did he provide evidence that his name was unlawfully replaced or that he was the valid nominee. The IEBC's role was limited to receiving party lists, and the dispute was an internal party matter. The court lacked jurisdiction to nullify the election or award damages in this context. The appeal was therefore dismissed for lack of merit, with costs to the respondents.

Court Disposition

appeal dismissed with costs

Orders

  • The appeal is dismissed with costs to the respondents.
