Miscellaneous Application / Judgment

  1. 1 Whether the Amagoro Land Disputes Tribunal had jurisdiction to determine the dispute and cancel the applicant's title deed.
  2. 2 Whether the claim before the tribunal was time barred under the Limitation of Actions Act.
  3. 3 Whether the tribunal acted ultra vires by purporting to cancel a registered title.

Ratio Decidendi

The court held that the Amagoro Land Disputes Tribunal lacked jurisdiction to entertain the Interested Parties' claim because it was time barred under Section 7 of the Limitation of Actions Act, as the cause of action accrued in 1975 and the claim was brought over thirty-five years later. Furthermore, the tribunal acted ultra vires by purporting to cancel a registered title deed, which was beyond its statutory powers under Section 3(1) of the Land Disputes Tribunals Act. The court found that the Interested Parties' claim was an afterthought and not supported by law. Consequently, the tribunal's decision was quashed, and the subordinate court was prohibited from giving effect to it.

Court Disposition

Application for judicial review allowed. Decision of the Amagoro Land Disputes Tribunal quashed. Prohibition issued against the subordinate court from enforcing the tribunal's decision. Costs awarded to the applicant.
