Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the Land Disputes Tribunal and Provincial Land Disputes Appeals Committee had jurisdiction to determine disputes relating to title and ownership of registered land.
  2. 2 Whether the orders made by the Tribunal and Appeals Committee affecting registered land were valid.
  3. 3 Whether the appellant's long occupation and first registration status protected his title from alteration or cancellation.

Ratio Decidendi

The court held that the Land Disputes Tribunal and the Provincial Land Disputes Appeals Committee acted in excess of their jurisdiction by purporting to cancel the appellant's title to registered land and ordering its transfer to the respondents. The Tribunal's jurisdiction is limited by section 3(1) of the Land Disputes Tribunals Act to matters involving division, boundary determination, occupation, or trespass, and does not extend to ownership or title of registered land. The orders made by both the Tribunal and the Appeals Committee were therefore nullities. The appeal was allowed, and the impugned decisions were set aside.
