The court found that the existence of a pending application for review in the lower court by the appellant, who is also pursuing an appeal, is contrary to the provisions of Order 45 Rule 1 and Rule 2 of the Civil Procedure Rules. These provisions do not permit an appeal and an application for review to run concurrently except in limited circumstances not applicable here.
