The court found that the Defendant failed to prove that he lawfully acquired the suit land from the late Kiloko Mitaa. The evidence showed that the late Kiloko was still reflected as the owner of the shares and the land in the Drumvale Farmers Co-operative Society register at the time of her death and at the time of the purported transfer. The agreement relied upon by the Defendant was not signed by the Defendant but by his brother, and no power of attorney was produced. There was no evidence that the share transfer was minuted or reflected in the society's register, nor was there proof of a valid transfer of the share certificate.
