Since the parties agreed that the test suit was determinative of liability for all related cases, the trial court was not at liberty to depart from its findings. Consequently, the appellant could not be held liable. On the issue of quantum, the court found that the award of Kshs. 700,000.00 was not inordinately high given the severity and permanence of the respondent's injuries, but this issue was rendered moot by the finding on liability.
