Ratio Decidendi

The court found that the 1st defendant had, through several letters, unequivocally admitted his indebtedness to the plaintiff in respect of the overdraft facility. The admissions were clear and unqualified, and there was no legal basis for the 1st defendant to later challenge the admitted debt on grounds of alleged illegal charges. The 2nd defendant, however, did not execute the facility offer nor make any admission of liability, and the plaintiff failed to provide sufficient material to establish her liability. Accordingly, summary judgment was entered against the 1st defendant for the sums claimed, while the application against the 2nd defendant was dismissed.
