Upon the death of the original defendant in 2015, the Plaintiffs failed to properly substitute the legal representative within the one-year period prescribed by Order 24 Rule 4(3) of the Civil Procedure Rules. The subsequent striking out of the substituted Defendants reverted the suit to its original state, and the time for substitution began to run afresh from July 2018.
