The court found that the applicant failed to prove contempt of court beyond reasonable doubt. The affidavit of service was defective as it did not specify how the process server identified the respondents or their residences, and the order served did not name all the alleged contemnors. Without proper service, contempt cannot be established. Even if service were proper, the evidence of breach was insufficient, as the applicant's account did not clearly demonstrate a violation of the restraining order. The court also struck out the respondents' advocate's affidavit as inadmissible on contested matters. Consequently, the application for committal to civil jail was dismissed.
