Ratio Decidendi

The court found that there was insufficient evidence to establish that KAKAMEGA/SHIAKHUNGU/1676 formed part of the deceased’s estate, as the only evidence on record related to ISUKHA/SHIAKHUNGU/1676, which was registered in the Objector’s name. Consequently, the court excluded this parcel from the estate distribution. The court then applied Section 40 of the Law of Succession Act, which governs the distribution of polygamous estates, and determined the shares of the estate among the four houses based on the number of children and surviving widows. The court rejected the Petitioner’s proposal as inconsistent with the statutory formula and adopted the Objector’s proposal as fair and just....
