Procedural Posture

Notice of Motion / Ruling on Application for Reinstatement After Dismissal for Want of Prosecution

  1. 1 Whether the suit should be reinstated after dismissal for want of prosecution.
  2. 2 Whether the plaintiff or their advocate was properly served with the notice to show cause.
  3. 3 Whether the plaintiff exercised due diligence in prosecuting the suit.

Ratio Decidendi

The court found that the plaintiff failed to take any action on the file for over two years and did not provide a plausible explanation for this inaction. Although the plaintiff claimed her advocate was not served with the notice to show cause, no affidavit was filed by the advocate to dispute service. The court held that, in the absence of such an affidavit, it must presume service was effected. The plaintiff's lack of diligence and failure to follow up on the matter justified the dismissal. Consequently, the application for reinstatement was dismissed as the plaintiff did not meet the threshold for setting aside the dismissal for want of prosecution.
