Ratio Decidendi

The court found that although the Appellant filed the present appeal before the earlier suit (ELC No. 388 of 2015) was formally withdrawn, the withdrawal was subsequently effected by order of the Deputy Registrar. As a result, there were no longer parallel proceedings, and the preliminary objection based on res sub judice had been overtaken by events. The objection was therefore dismissed. However, the court held that the Appellant should bear the costs of the objection, as the procedural overlap necessitated the Respondents' application.
