The grant obtained by the 1st defendant in Kerugoya Succession Cause No. 199 of 1994 was invalid, as it was issued in respect of a living person and contrary to the will. Any registration of the 1st, 2nd, and 3rd defendants as proprietors was therefore fraudulent. The 4th and 5th defendants acted in good faith based on documents that appeared valid and were not complicit in fraud.
