The only error apparent on the face of the record was the direction that the retrial be held at Mariakani, when the suit had originated and been concluded at the Chief Magistrate's Court at Mombasa. The court corrected this error by ordering that the retrial take place at the Chief Magistrate's Court at Mombasa before a different magistrate.
