The Court of Appeal held that the appellant's contract of employment was for five years, renewable for a further five years only upon mutual agreement, and not a fixed ten-year term. The contract contained a termination clause, making it terminable by either party before expiry. The termination was by mutual consent, initiated by the respondent. Under clause 20.1 of the contract, the appellant was entitled to the balance of her salary for the unexpired period (44 months), gratuity at 25% of gross salary for the period served (16 months), and salary in lieu of 10 days' leave.
