Procedural Posture

Civil Case / Ruling on Application to Restore Land Boundaries

  1. 1 Whether the applicant is entitled to an order directing the Land Registrar and Surveyor to restore the boundaries of the disputed parcels to their original positions.
  2. 2 Whether the present application is an abuse of the court process given previous determinations and closure of the case.

Ratio Decidendi

The court held that the Land Registrar, with the assistance of the District Surveyor, had already determined the precise boundary between the parcels in dispute, and this determination was adopted as a judgment of the court at the applicant's own request. The case was then closed. The applicant failed to provide evidence that the respondent had interfered with the boundary after the Registrar's determination. The court found that the present application sought to reopen a matter already conclusively determined and was therefore an abuse of the court process. Accordingly, the application was dismissed with costs.

Court Disposition

application dismissed with costs

Orders

  • The application is dismissed with costs to the respondent.
