The court held that proceeding with the civil suit while the appeals are pending would risk rendering the appeals nugatory and result in a duplication of proceedings over the same subject matter, contrary to the prudent use of judicial time. The court further found that the delay in filing the application was not inordinate and that any prejudice to the respondent or the minor could be compensated by an award of costs....
