The court found that the Ololulunga Land Disputes Tribunal acted in excess of its jurisdiction by issuing orders of eviction and determining ownership of land, matters which are outside the scope of its statutory mandate under Section 3 of the Land Disputes Tribunals Act. The Registered Land Act vests jurisdiction to inquire into title and make orders of eviction in the High Court, not the Tribunal. Consequently, both the Tribunal's decision and its adoption by the Magistrate's Court were null and void.
